On 8 May 2024, the Privy Council upheld the decision of the Court of Appeal of the Republic of Trinidad and Tobago (COA) in the matter JCPC 2014/0013 Wild Goose Limited (Appellant) v Environmental Management Authority (EMA) of Trinidad and Tobago (Respondent). After consideration of Wild Goose Limited’s application for permission to appeal the order made by the COA and the EMA’s written submission in opposition, the Privy Council ordered:
1. Permission to appeal be REFUSED because the application does not raise an arguable point of law or a point of law of public importance.
2. Subject to any submissions, to be filed by the Appellant within 21 days of the date of this Order and by the Respondent if so advised within a further 14 days, the Appellant pay the Respondent’s costs, the amount of those costs be assessed if not agreed.
